VAN NUYS, Calif., March 24, 2000 (PRIMEZONE) -- TGA Aviation, Inc. announced that it filed suit against Stevens Aviation, Inc. and its controlling shareholder, Thomas Foley, for breach of contract, misrepresentation and conversion. TGA's complaint relates to untimely, incomplete and improper repairs to a Gulfstream II aircraft undertaken at Stevens' Greenville, South Carolina facility. The complaint alleges that Stevens shut down its widely advertised Gulfstream refurbishment facilities in Atlanta without informing TGA Aviation that its certified Gulfstream refurbishment specialists would not relocate to its Greenville facilities. The complaint alleges that Stevens failed to advise TGA that its Greenville facility was inadequate for Gulfstream refurbishment and that it had been unable to recruit personnel with expertise in aircraft refurbishment to work in Greenville. During the refurbishment process the Stevens personnel in charge of the TGA project resigned. The complaint alleges that refurbishment of TGA's Gulfstream II was never properly completed, that Stevens failed to commence prefabrication work, that refurbishment ran 25 weeks longer than scheduled and that Stevens disabled mechanical functions of the aircraft so that it could not be moved elsewhere to refurbish the aircraft properly. TGA seeks damages exceeding $1 million for costs of properly completing the refurbishment, for misrepresentation and for lost charter revenue. In addition the complaint seeks treble damages pursuant to South Carolina law, as well as punitive damages.
