Wavestream Corporation Responds to Misleading Press Release


SAN DIMAS, Calif., Dec. 21, 2007 (PRIME NEWSWIRE) -- Wavestream Corporation (www.wavestream.com), a manufacturer of compact, highly efficient solid-state power amplifiers, today responded to a press release issued by CAP Wireless concerning the resolution of a patent action brought by Wavestream. In the release, CAP Wireless wrongly contends that certain purported facts were "so obvious to the U.S. District Court" that the lawsuit was dismissed.

Contrary to the implication in that press release, the District Court made no finding whatsoever concerning CAP Wireless' claimed "fact" that its technology "is different from that offered by Wavestream" or that CAP Wireless "provides a significantly more advanced approach to the design and manufacture of high-power amplifiers." In fact, the District Court made no finding whatsoever about how products offered by Wavestream compare with any CAP Wireless product, much less that CAP Wireless' technology was in any way more advanced. The District Court simply concluded that one part of the patent claims at issue is to be narrowly interpreted to encompass only one kind of slotline transmission line, while CAP Wireless' product uses a different kind of transmission line. Moreover, the kind of transmission line used by CAP Wireless -- an "antipodal finline" -- is an old design; there is nothing new or advanced about it -- the court simply concluded it was different than the transmission line claimed in the patent.

Moreover, CAP Wireless' claim that it now has "free rein" is also incorrect. The patents at issue in Wavestream's lawsuit remain valid and in effect, and continue to provide Wavestream protection against anyone -- including CAP Wireless -- who may seek to use the patented technology in the future.

Accordingly, there is no basis for CAP Wireless' misleading claims in its press release.
