Shaheen, Novoselsky, Staat, Filipowski & Eccleston Files Lawsuit for Consumer Fraud in Fantasy Football Case

AFFL Failed to Pay $60,000 to Grand Prize Winner of Its Contest


CHICAGO, April 14, 2010 (GLOBE NEWSWIRE) -- Shaheen, Novoselsky, Staat, Filipowski & Eccleston, P.C. (SNSFE) announces the filing of a lawsuit in the Law Division of the Circuit Court of Cook County, Illinois against Chicago Fantasy Sports, LLC, Wade J. Golab and Robert J. Smolarczyk (the "Defendants") for consumer fraud, fraud and breach of contract.

Jack L. Haan represents the Plaintiff, Jeff Gill, who entered and participated in the Defendants' fantasy football contests known as the American Fantasy Football League ("AFFL") in 2009. With one of his teams, Mr. Gill won the Championship Grand Prize of $60,000.00, a Waterford Crystal trophy valued at $9,000, and other prizes. The Defendants have failed to pay Mr. Gill these prizes.

Plaintiff alleges that the Defendants represented in their Rules and Regulations that the AFFL's cash prizes and awards were "guaranteed." Furthermore, the Defendants accepted entry fees, but never disclosed to the entrants prior to the start of the contests that they did not have the necessary monies to pay the winners. Plaintiff further alleges that the Defendants admit they do not have the monies available now to pay Mr. Gill.

Commenting on the lawsuit, Mr. Haan stated: "Unfortunately, this is not the first time this conduct has occurred in the fantasy gaming industry. But this type of conduct – business owners accepting entry fees from consumers and then failing to pay winners – must come to an end, starting now."
