Consumers Victorious Against Dealer

SAINT LOUIS, MO--(Marketwire - Oct 1, 2012) - St. Louis County jury unanimously returned a $10,000 verdict for fraudulent misrepresentation, unfair business practices and breach of warranty against Revox Corporation d/b/a West County Auto Plaza.

Consumers Albert Mathis and Ronitta Childress purchased a 2002 Jaguar XK8 from the dealership located on Manchester road back in May of 2009. Two days after purchase, the vehicle failed to start; a problem that plagued the vehicle for several months. After the dealer refused all requests to cover any of the costs of repair and refused to take the vehicle back on trade, the consumers hired the national consumer protection law firm, Krohn & Moss, Ltd.

Krohn & Moss, Ltd. sought the help of James Ray, of the International Vehicle Appraiser's Network, to inspect the Jaguar and assess its value. Mr. Ray found that the vehicle suffered a severe accident and showed several permanent indicators of accident damage, including junkyard markings in the engine compartment." "The Jag was worth nowhere near the $20,000 they paid for it," he explained to the jury as they reviewed color photographs of the damage.

At the time of sale, Mr. Mathis and Ms. Childress relied on West County's fast-talking salesman, Fred Williamson, to explain the accident: "When Fred showed us the CarFax®, he told us not to worry about it because it was just a 'fender bender,'" Childress explained. "He talked about it like he knew exactly what had happened."

"The laws in Missouri were designed to protect against these types of unfair practices," attorney Adam C. Maxwell of Krohn & Moss, Ltd. explained. "Consumers rely on the expertise of car dealers in purchasing vehicles, and the legislature recognized the need to preserve fundamental honesty in transactions with the public," he added.
