Companies Division of Court of Appeal denies Roosland's request for injunction


The Companies Division ruled that Roosland cannot be considered to be an applicant in the inquiry proceedings. The Companies Division also found that even if this were the case, Roosland's request could still not be granted given that it has neither been argued nor demonstrated that the injunction applied for is in the interests of the inquiry or is necessary in connection with the situation at AND.
 
Roosland joined as an interested party in the proceedings as a result of the inquiry report of 5 March 2002. In that capacity, Roosland applied to the Companies Division on 18 June for an immediate injunction. The Companies Division has now refused that application.
 
The Companies Division will rule on the substance of the case on 29 August 2002.
