Koebenhavns Lufthavne A/S (Copenhagen Airports A/S): Judgment in Baggage Case


COPENHAGEN, Denmark, Aug. 27, 2002 (PRIMEZONE) -- The Danish Eastern High Court today delivered a judgment in an action brought against SAS by Copenhagen Airports A/S concerning the payment by SAS for the airport company's sorting of baggage handled by SAS in 1999. Copenhagen Airports A/S invoiced SAS and other handling companies for this service in 1999.

The judgment established that Copenhagen Airports A/S had no legal basis for charging for the service, and the claim against SAS was therefore dismissed.

Today's judgment by the Eastern High Court has the effect that Copenhagen Airports A/S must write off a claim of approximately DKK 50 million.

The judgment only concerns the year 1999, whereas the parties made a voluntary agreement for payment by the handling companies for baggage sorting services, which came into effect from 2000. This agreement was recently extended until the end of 2005.

The High Court judgment can be appealed to the Supreme Court. A decision thereon will be made following a review of the ratio decidendi.
