Hard to Treat Diseases Incorporated Describes Dismissal of Oklahoma Case


DELRAY BEACH, Fla., Nov. 23, 2004 (PRIMEZONE) -- Hard to Treat Diseases Incorporated (HTTD) (Pink Sheets:HTDS) Announces Details Regarding Dismissal of Oklahoma Case.

On November 2, 2004, the District Court of Oklahoma entered an Order dismissing the Second Amended Petition of Shinn Capital Group, Inc., T-19, Inc., an Oklahoma corporation, and Hard to Treat Diseases, Inc, an Oklahoma corporation ("Plaintiffs") against NatCel, Inc., Richard Ishmael, Wei Chen, Colm King, and Hard to Treat Diseases, a Florida Corporation ("Defendants"), in Case No. CJ-2004-1616-67, District Court in and for Oklahoma County.

In the Second Amended Petition, Plaintiffs had sued Defendants for five counts: (1) return of Tubercin; (2) funds purportedly loaned to Hard to Treat Diseases, a Florida corporation; (3) a judicial determination that the Share Exchange Agreement was terminated and rescinded; (4) payment of corporate debentures that are purportedly due Shinn Capital from HTTD Oklahoma and T-19; and (5) a determination of the parties rights under the Share Exchange Agreement. Judge Carolyn Ricks sustained Defendants' Motion to Dismiss.

In the Court's Order dismissing the Second Amended Petition, the Court further ordered that the dismissal is without prejudice for Plaintiffs (Shinn Capital Group, Inc., T-19, Inc., an Oklahoma corporation, and Hard to Treat Diseases, Inc, an Oklahoma corporation) to pursue their claims in the Federal Court litigation pending in West Palm Beach Florida.

The dismissed claims are not alleged in the Florida litigation; therefore, those claims are no longer pending against HTTD in any court. Ronald Shinn and Gerry Knight, defendants in the Florida, Federal litigation, have filed claims against HTTD, but HTTD has filed a motion to dismiss those claims. A ruling from the Court is pending.
