The action, filed March 22, 2005, was pending in the Suffolk County (Massachusetts) Superior Court, Business Litigation Session. On July 21, 2005, the Court approved the plaintiff's request to voluntarily dismiss this action, which bears the caption: Wesley Childs, on behalf of Viisage Technology, Inc. v. Bernard Bailey, B.G. Beck, Denis K. Berube, Charles E. Levine, Harriet Mouchy-Weiss, Peter Nessen, Chistoph Von Der Malsburg, Marcel Yon and Nominal Defendant Viisage Technology, Inc., Civil Action No. 05-2247.
