FCA WILL NOT PROPOSE ANY SANCTIONS AGAINST COMPANIES OF THE
BITUMINOUS ROOFING INDUSTRY

The Finnish Competition Authority (FCA) has closed its
investigation of the alleged prohibited exchanges of information
in the bituminous roofing industry. On 16 February 2007 the FCA
announced its decision to close the case without proposing any
sanctions against companies in the industry.

The FCA justified its decision on the grounds that the legal
position may have been unclear and that the companies had changed
their information handling practices already before the FCA
launched its investigations.

In March 2002 the FCA conducted an audit of all major companies
engaged in bituminous roofing manufacturing and contracting,
Lemminkäinen included. In March 2006 the FCA sent Lemminkäinen a
copy of its draft proposal to the Market Court for comment. In
the draft proposal the FCA claimed that prohibited exchanges of
information had taken place on the bituminous roofing market
during the years 1996-2002.

In its response to the FCA in June 2006, Lemminkäinen clarified
that the information in question concerned mainly total sales
volumes which had been gathered for the purpose of preparing
general construction sector statistics. The information was
strategically insignificant and had no effect on the competitive
behaviour of the companies.
