The class action complaint was brought on behalf of Owens-Illinois ("O-I") Salary Retirement Plan Participants employed at O-I in its Brockway Plastic Products Group, who were denied early retirement benefits when the O-I Brockway Plastic Products Group was sold to Graham Packaging Company in October, 2004. The Complaint alleges that Defendants breached their fiduciary duties and failed to provide benefits to the Class, and that Owens-Illinois purposefully changed and mischaracterized the employment status of the Class in connection with the sale to Graham with the intent to deprive the Class of the Enhanced Retirement and retiree health benefits.
