Notification of Voting Rights
Notification pursuant to sec. 21(1) in connection with sec. 22(1) sentence
1 no. 6, sentences 2 and 3 WpHG
Ladies and Gentlemen,
In the name and on behalf of the companies referred to below, we notify the
following:
1. Atticus Capital Holdings LLC, New York, NY 10153, USA, notifies pursuant
to sec. 21(1) WpHG that the stake in the voting rights in Colonia Real
Estate AG, 50667 Köln, exceeded the threshold of 3 % on January 1, 2008.
With respect to all voting rights in Colonia Real Estate AG, at this time
the stake of Atticus Capital Holdings LLC in the voting rights amounted to
3.39 % (voting rights arising from 760,140 no-par value shares). 3.39 % of
all voting rights (voting rights arising from 760,140 no-par value shares)
in Colonia Real Estate AG are to be attributed to Atticus Capital Holdings
LLC pursuant to sec. 22(1) sentence 1 no. 6, sentences 2 and 3 WpHG. In
this regard, the voting rights of the following shareholder holding a stake
of 3 % or more in the voting rights in Colonia Real Estate AG are to be
attributed to Atticus Capital Holdings LLC:─ Atticus European Fund, Ltd.
2. Atticus LP Incorporated, St. Peter Port, Guernsey GY1 3 EL, notifies
pursuant to sec. 21(1) WpHG that the stake in the voting rights in Colonia
Real Estate AG, 50667 Köln, exceeded the threshold of 3 % on January 1,
2008. With respect to all voting rights in Colonia Real Estate AG, at this
time the stake of Atticus LP Incorporated in the voting rights amounted to
3.39 % (voting rights arising from 760,140 no-par value shares). 3.39 % of
all voting rights (voting rights arising from 760,140 no-par value shares)
in Colonia Real Estate AG are to be attributed to Atticus LP Incorporated
pursuant to sec. 22(1) sentence 1 no. 6, sentences 2 and 3 WpHG. In this
regard, the voting rights of the following shareholder holding a stake of 3
% or more in the voting rights in Colonia Real Estate AG are to be
attributed to Atticus LP Incorporated:─ Atticus European Fund, Ltd.
3. Atticus Capital LP (formerly known as ACM US LP), New York, NY 10153,
USA, notifies pursuant to sec. 21(1) WpHG that the stake in the voting
rights in Colonia Real Estate AG, 50667 Köln, exceeded the threshold of 3 %
on January 1, 2008. With respect to all voting rights in Colonia Real
Estate AG, at this time the stake of Atticus Capital LP in the voting
rights amounted to 3.39 % (voting rights arising from 760,140 no-par value
shares). 3.39 % of all voting rights (voting rights arising from 760,140
no-par value shares) in Colonia Real Estate AG are to be attributed to
Atticus Capital LP pursuant to sec. 22(1) sentence 1 no. 6 WpHG. In this
regard, the voting rights of the following shareholder holding a stake of 3
% or more in the voting rights in Colonia Real Estate AG are to be
attributed to Atticus Capital LP:─ Atticus European Fund, Ltd.
4. Atticus Management Limited, St. Peter Port, Guernsey GY1 3 EL, notifies
pursuant to sec. 21(1) WpHG that the stake in the voting rights in Colonia
Real Estate AG, 50667 Köln, exceeded the threshold of 3 % on January 1,
2008. With respect to all voting rights in Colonia Real Estate AG, at this
time the stake of Atticus Management Limited in the voting rights amounted
to 3.39 % (voting rights arising from 760,140 no-par value shares). 3.39 %
of all voting rights (voting rights arising from 760,140 no-par value
shares) in Colonia Real Estate AG are to be attributed to Atticus
Management Limited pursuant to sec. 22(1) sentence 1 no. 6 WpHG. In this
regard, the voting rights of the following shareholder holding a stake of 3
% or more in the voting rights in Colonia Real Estate AG are to be
attributed to Atticus Management Limited:─ Atticus European Fund, Ltd.
