The Q2 2008 press release referred to the class action suit brought against the Company as having been settled. While the Company's management anticipates a settlement, the matter is still pending before the Court. As noted in the Company's 10Q filing, on or before June 17, 2008, the parties notified the court that a memorandum of understanding had been reached in regard to a compromise and settlement. The parties are in the process of finalizing a formal class action settlement agreement and anticipate submitting the finalized settlement agreement for preliminary approval to the court on or before August 21, 2008.
