Medicis and certain of its officers are charged with violating the
Securities Exchange Act of 1934, for issuing a series of materially false
statements that concealed and failed to disclose that the Company had
published materially inaccurate and false financial statements since
mid-2003. It was only on September 24, 2008, that Medicis first revealed
that it would be forced to restate its financial statements for the five
year period -- from July 1, 2003 to June 30, 2008 -- as a result of failing
to properly account for sales returns. Investors then realized Medicis had
artificially inflated its results during that time, and shares of the
Company immediately declined.
