Pending Litigation by Bennington Foods, LLC d/b/a Bennington Group, Against St. Croix Renaissance Group, LLLP

Civil Case # 2006-0154, United States District Court of the U.S. Virgin Islands Division of St. Croix


NEW YORK, Jan. 2, 2009 (GLOBE NEWSWIRE) -- Bennington Foods, LLC d/b/a Bennington Group (BG) would like to issue the following statement on the above pending litigation.

It is hereby confirmed that BG is pursuing legal action against St. Croix Renaissance Group, LLLP (SCRG) in the United States District Court of the U.S. Virgin Islands, Division of St. Croix. Information on the pending litigation may be obtained via the Complaint filed by BG which fully addresses all pertinent issues pertaining to the nature of the litigation and is a matter of public record. Interested parties may obtain the information via the United States District Court of the U.S. Virgin Islands, Division of St. Croix, Civil Case #2006-0154. BG will issue no further statements on the litigation at this time.

With reference to the inquiries of the effects of this litigation on the proposed $160 Million facility (rum distillery) to be built by Diageo PLC at the disputed property at the SCRG site and the $250 Million Government Bond Issue for the purpose of raising capital for this project, neither BG nor attorneys representing BG have any direct knowledge of the proposed transactions for the site currently disputed by BG. Therefore, BG and legal representatives of BG will not issue a statement on the same at this juncture. All questions relating to this matter should be addressed to the offices or representatives of Diageo PLC, the offices, representatives of JP Morgan Securities, and/or the Office of the Governor of the U.S. Virgin Islands.

As a matter of policy, BG does not comment on ongoing litigation, and therefore, will not issue any further comments or remarks on this matter until further notice.
