On June 1, 2010, Thornburg Investment Management, Inc., Santa Fe, USA has
informed us according to Article 21, Section 1 of the WpHG that via shares
its Voting Rights on Fresenius Medical Care AG & Co. KGaA, Bad Homburg,
Deutschland, have exceeded the 3% limit of the Voting Rights
on September 24, 2009 and now amount to 3.76% (this corresponds to
11,070,196 Voting Rights). According to Article 22, Section 1, Sentence 1,
No. 6 of the WpHG, 3.76% of the Voting Rights (this corresponds to
11,070,196 Voting Rights) are to be attributed to Thornburg Investment
Management, Inc.

On June 1, 2010, Mr. Garrett Thornburg, USA has informed us according to
Article 21, Section 1 of the WpHG that via shares his Voting Rights on
Fresenius Medical Care AG & Co. KGaA, Bad Homburg, Deutschland, have
exceeded the 3% limit of the Voting Rights
on September 24, 2009 and now amount to 3.76% (this corresponds to
11,070,196 Voting Rights). According to Article 22, Section 1, Sentence 1,
No. 6 of the WpHG in connection with sentence 2 of the WpHG, 3.76% of the
Voting Rights (this corresponds to 11,070,196 Voting Rights) are to be
attributed to Mr. Garrett Thornburg.
