NEW YORK, NY--(Marketwire - January 14, 2011) - Cooley LLP announced that its client, Edward McNenney, a former executive at insurance broker Marsh & McLennan Cos., has been cleared of all charges as the New York Attorney General (NYAG) has dismissed the indictment against him.
In 2005, the NYAG indicted Mr. McNenney and several other Marsh executives alleging participation in a bid rigging conspiracy in the market for excess casualty insurance. In 2008, Mr. McNenney was acquitted on 21 out of 22 counts tried during a 10-month bench trial. The conviction on the single count, for violation of New York's antitrust statute known as the Donnelly Act, was thrown out in July 2010 by New York State Supreme Court Justice James Yates due to NYAG's failure to produce exculpatory evidence during the trial. This week, NYAG announced that it would not retry the Donnelly Act count and NYAG dismissed the indictment against Mr. McNenney.
