Harju District Court terminated a civil claim against AS Tallinna Vesi


On 16.06.2011 Harju County court issued a decision whereby it decided to terminate the proceedings initiated by Mrs. Silja Lepp as the claim had been submitted to the wrong court and against the wrong defendant. Mrs. Silja Lepp submitted a claim to Harju County Court against AS Tallinna Vesi, alleging that the price of water services in 2008 was excessively high and claiming the return of part of sums paid. 



AS Tallinna Vesi was represented by Law Office Raidla Lejins & Norcous. According to attorney-at-law Toomas Vaher the decision of Harju County court confirms that in cases of claims regarding the price of water service the addressee of the claim is an administrative body, not the water undertaking. „The water undertaking simply follows mandatory legal acts and does not determine the price of water services. There was no basis to critique the water undertaking neither in court nor in public media nor submit claims against the water undertaking, since we are dealing with a very strictly regulated market here, where the prices are established by way of administrative acts. In the case of Mrs Silja Lepp’s claim we were dealing with an unfounded claim without a possibility to win, which only cast a negative shadow on the water company without any basis whatsoever," said Vaher.

AS Tallinna Vesi would like to point out to its investors that this court decision is entirely separate from the Court proceedings the company has initiated against the Competition Authority regarding the 2011 tariff application.
