The woman claimed that the landlord had been aware that the dog had dangerous propensities, and therefore had acted negligently in allowing it to remain on the apartment's premises. However, the Superior Court judging the case ruled in the landlord's favor, claiming that there was no evidence to demonstrate that he was aware of the dog's potential dangerousness.

This case illustrates the often confusing nature of Pennsylvania's dog bite liability laws. In Pennsylvania, the owner of a dog who bites someone else is strictly liable if the bite leads to severe damages, or if the dog had attacked someone before. This means that they can be held accountable for medical expenses as well as any other losses which can be shown to have occurred as a result of the attack. Severe injuries are those which involve broken bones or lacerations which require multiple stitches or cosmetic surgery. For non-severe injuries, the dog's owner is only liable for medical expenses.
