Securities Trading Act] with the objective of Europe-wide distribution

informed us according to Article 21, Section 1 of the WpHG that via shares
its voting rights on Fresenius Medical Care AG & Co. KGaA, Bad Homburg,
Germany, ISIN: DE0005785802, WKN: 578580 have crossed the 5% threshold of
the voting rights on February 6, 2013 and on that day amounted to 5.003%
(this corresponds to 15,147,822 voting rights). According to Article 22,
Section 1, Sentence 1, No. 6 WpHG, 5.003% of the voting rights (this
corresponds to 15,147,822 voting rights) is to be attributed to the
company.

Mr. Garrett Thornburg, Santa Fé, NM, United States has informed us
according to Article 21, Section 1 of the WpHG that via shares his voting
rights on Fresenius Medical Care AG & Co. KGaA, Bad Homburg, Germany, ISIN:
DE0005785802, WKN: 578580 have crossed the 5% threshold of the voting
rights on February 6, 2013 and on that day amounted to 5.003% (this
corresponds to 15,147,822 voting rights). According to Article 22, Section
1, Sentence 1, No. 6 WpHG, 5.003% of the voting rights (this corresponds to
