Federal Circuit Rules in Favor of InterDigital in Dispute With LG


WILMINGTON, Del., June 7, 2013 (GLOBE NEWSWIRE) -- InterDigital, Inc. (Nasdaq:IDCC), a wireless research and development company, today announced that the United States Court of Appeals for the Federal Circuit has ruled in favor of the company in its ongoing dispute with LG Electronics (and LG affiliates). The Federal Circuit determined that LG should not have been terminated from United States International Trade Commission (Commission) Investigation No. 337-TA-800 initiated by InterDigital.

LG was terminated from the Commission investigation based on LG's allegation that it has a continuing 3G license under an expired license agreement with InterDigital, and that the parties' dispute over whether LG possesses such a license should be arbitrated under the terms of that agreement. The Federal Circuit panel ruled that LG's assertion of arbitrability was "wholly groundless" and found that there "simply is no plausible argument that LG's license for 3G products survived the termination of the Agreement." 

By rule, LG and the Commission have 45 days to petition for rehearing of the Federal Circuit's decision and may petition the U.S. Supreme Court for a writ of certiorari within 90 days after entry of the judgment or a request for rehearing is denied, whichever is later. After the time period for petitioning for rehearing passes or the Federal Circuit denies any such petition, the Federal Circuit will issue its mandate remanding the case for further proceedings by the Commission.
