On 1 July 2013 AB Klaipėdos Nafta (hereinafter, the Company) received a ruling from the Court of Appeal of Lithuania, whereby the appeals of AB Kauno Dujotiekio Statyba and UAB Šiaulių Dujotiekio Statyba, as well as of PPS Pipeline Systems GmbH against the judgement of the Klaipėda Regional Court, dated 16 April 2013, were rejected (the Company notified about the progress of the proceedings by giving notifications on material events on 29 January 2013, 8 March 2013, 17 April 2013 and 2 May 2013). In its ruling the Court of Appeal of Lithuania admitted that the Company had not breached any legal requirements when recognising the German concern PPS Pipeline Systems GmbH to be the winner of the international procurement for engineering, procurement and construction (EPC) of the natural gas pipeline system carried out by way of negotiations with publication of a contract notice.
The ruling of the Court of Appeal of Lithuania came into effect on the date of its adoption (28 June 2013), but the process participants have the right to file a cassation appeal to the Supreme Court of Lithuania within one month after its effective date.
