Morgan Drexen Commends Federal Judge Ruling on Phone Data Collection as "Likely Unconstitutional"

Points to Fundamental Right to Privacy


COSTA MESA, Calif., Dec. 16, 2013 (GLOBE NEWSWIRE) -- In a show of support for the constitutional protection of privacy, Morgan Drexen Integrated Systems (http://www.morgandrexen.com) today commended a federal judicial ruling that clearly expressed the view that the NSA program of the wholesale collection of bulk U.S. citizen phone data was likely "unconstitutional."

In a terse comment on the NSA data collection, U.S. District Court Judge Richard Leon said, "I cannot imagine a more indiscriminate and arbitrary invasion than this systematic and high-tech collection and retention of personal data on virtually every single citizen for purposes of querying it and analyzing it without judicial approval."

"What this boils down to is the question of whether it is unconstitutional to simply gather copious amounts of data from U.S. citizens without their knowledge or permission," said Morgan Drexen CEO, Walter Ledda. "We absolutely commend Judge Leon for his stand against the invasion of personal privacy."

Ledda pointed to Judge Leon's comments on page 43 of the ruling which said, "The threshold issue that I must address, then, is whether plaintiffs have a reasonable expectation of privacy that is violated when the Government indiscriminately collects their telephony metadata along with the metadata of hundreds of millions of other citizens without any particularized suspicion of wrongdoing" as a fundamental breach of our constitutional rights.

In today's ruling, Judge Leon also dismissed the government's claim that mining for citizen data was necessary to thwart terrorist plots writing "The Government does not cite a single instance in which analysis of the NSA's bulk metadata collection actually stopped an imminent attack, or otherwise aided the Government in achieving any objective that was time-sensitive in nature."
