Keller Rohrback L.L.P. Investigating Adequacy of Settlement in Concussion-Injury Litigation on Behalf of Retired NFL Players

SEATTLE, Jan. 16, 2014 (GLOBE NEWSWIRE) -- Attorney Advertising. Keller Rohrback L.L.P. is currently investigating the adequacy of the $765 million proposed settlement between the National Football League ("NFL") and retired NFL players. Our investigation focuses on whether the proposed settlement related to concussion-related injuries will provide enough funds to ensure that all retired-NFL players who have potential claims will be sufficiently compensated. The proposed settlement was rejected by the Honorable Anita B. Brody, United States District Judge for the Eastern District of Pennsylvania on January 14, 2014. Judge Brody found, among other things, that the $765 million fund created for retired NFL players "may lack the necessary funds to pay" all retired NFL players who qualify for awards under the proposed settlement. Judge Brody also expressed concern for whether there will be sufficient funds to treat future injuries, and why retired NFL players who receive an award will be barred from bringing any claims against the NCAA under the current terms of the settlement.

The potential recovery to retired NFL players, though substantial, is not a guaranteed amount. For instance, retired professional football players with ALS may receive up to a maximum of $5 million, and players with Parkinson's disease are eligible for an award of up to $3.5 million. With over 20,000 retired football players in the proposed class of persons subject to the settlement, the $765 million fund may not provide maximum benefits to retired NFL players.
