Ruling of the Supreme Court in criminal matter No. 1-09-4486

With the ruling of the Supreme Court dated 30.06.2014, the ruling of the Tallinn Circuit Court dated 19.06.2013 was annulled, among other things, in respect the part in which AS Järvevana was convicted according to section 298 (4) of the Penal Code (giving a bribe).

The Supreme Court ruled that land exchanges were permitted and legal. Furthermore, the Supreme Court confirmed that it has not been established that the value of the properties was assessed incorrectly during the exchange proceedings.

However, the Supreme Court decided to convict AS Järvevana according to section 297 (3) of the Penal Code (granting of gratuities), leaving the penalty imposed by the Circuit Court unchanged. Thus, the pecuniary punishment in the sum 798,000 (seven hundred and ninety-eight hundred thousand) euros imposed on AS Järvevana, remained in force. AS Järvevana was ordered payment of compensation levies in favour of the state in the sum of 532 euros and 50 sents (instead of the previous 800 euros). At the same time, the Republic of Estonia was ordered payment of 15,000 euros in favour of AS Järvevana to cover the fee paid to the defence counsel in the cassation proceedings.
