Coriant Announces Favorable Resolution of Tellabs-Related U.S. Patent Infringement Litigation

Coriant has announced the resolution of Tellabs-related litigation pending in the Eastern District of Texas with Cheetah Omni LLC ("Cheetah"). It involves a number of patents including U.S. Patents 6,940,647 and 6,856,459.


NAPERVILLE, Ill., Sept. 4, 2014 (GLOBE NEWSWIRE) -- via PRWEB - Coriant, a global supplier of dynamic metro-to-core transport solutions, today announced the resolution of Tellabs-related litigation pending in the Eastern District of Texas with Cheetah Omni LLC ("Cheetah") involving a number of patents including U.S. Patents 6,940,647 and 6,856,459.

Tellabs was acquired by Marlin Equity Partners, a global investment firm, in December 2013. In January 2014, the Tellabs packet optical product portfolio was merged under the Coriant brand, while the Tellabs access product portfolio was established as an independent business.

In July 2011, Cheetah sued Tellabs and five other companies, alleging that each defendant infringed certain Cheetah patents. On February 3, 2014, after more than two years of litigation, during which all other defendants settled with Cheetah, Coriant/Tellabs prevailed on its motion for summary judgment of non-infringement as to the '647 and '459 Patents, which Cheetah asserted against certain Reconfigurable Optical Add Drop Multiplexer ("ROADM") technologies within the 7100 series product line. Following the entry of summary judgment, the court awarded Coriant/Tellabs costs of over $160,000.

Cheetah appealed these decisions. Under a settlement agreement that resolves the litigation, including the pending appeal, Coriant will receive a license to Cheetah's entire optical communication patent portfolio and Cheetah will make a payment to Coriant of an unspecified amount. Stipulations of dismissal will be filed in the trial and appellate courts. All other terms of the settlement are confidential.
