According to the lawsuit, On October 29, 2014, ARCP announced that its annual financial statements included in the merger registration statement issued in connection with the exchange of Cole shares for ARCP shares were materially inaccurate and must be restated.   The lawsuit claims that as a result, the value of ARCP has declined causing former Cole shareholders damages.
