In 2013 the shipping company Scandlines filed a complaint to the European Commission over alleged state aid to Øresundsbro Konsortiet I/S (The Øresund Bridge Consortium). Scandlines complained that the State guarantees given by the Swedish and the Danish States related to the Consortium's borrowings to finance the Øresund fixed link, amounted to illegal State aid.
Later in January 2014 Scandlines filed a second complaint concerning the certain tax conditions for the Øresund-project, which the company also found in non-compliance with the State aid rules.
On 15 October 2014 the EU Commission decided upon the complaints. The Commission found that the Consortium is governed by the state aid rules, but that both the State guarantees, as well as the certain tax conditions, are fully compatible with the State aid rules.
The Ministry of Transportation has now informed that Scandlines Øresund incl. others have chosen to refer the Commission's decision to the EU General Court.
The debt, raised to finance A/S Øresunds fixed assets, is repaid through dividends from Øresundsbro Konsortiet.

Rederiet Scandlines indgav i 2013 en klage til EU-Kommissionen over påstået statsstøtte til Øresundsbro Konsortiet. Scandlines påklagede, at de statsgarantier, som den svenske og den danske stat har stillet i forbindelse med Konsortiets lånoptagning til finansiering af Øresundsforbindelsen, udgjorde ulovlig statsstøtte.
Scandlines indgav senere i januar 2014 en ny klage, der vedrørte de skattemæssige vilkår for Øresundsprojektet, som rederiet ligeledes fandt i uoverensstemmelse med statsstøttereglerne.
EU-Kommissionen afgjorde den 15. oktober 2014 klagesagerne. Kommissionen fandt, at Konsortiet er omfattet af statsstøttereglerne, men at såvel de statslige garantier, som de særlige skattemæssige vilkår, er fuldt forenelige med statsstøttereglerne.
Transportministeriet har nu oplyst, at Scandlines Øresund m.fl. har valgt at indbringe Kommissionens afgørelse ved EU-Retten.
Den gæld, der er optaget til finansiering af A/S Øresunds anlægsaktiver, tilbagebetales via udbytter fra Øresundsbro Konsortiet.
