On 5th of June 2015, the Tallinn Administrative Court dismissed AS Tallinna Vesi’s complaint in tariff dispute held between the Company and the Competition Authority of Estonia. The Court did not publish the background to the decision. The Court will publish the reasoning after the official notice for the intention of appealing the decision is submitted to the court.
The Chairman of the Management Board, Karl Heino Brookes confirmed that the Company will appeal the Tallinn Administrative Court’s decision to the District Court. Appealing the Court’s 5th of June decision means that the dispute has not reached its final solution.
Until the final verdict to the tariff dispute held between AS Tallinna Vesi and the Competition Authority, the preliminary legal protection applied by Estonian Courts against the CA’s prescription for decreasing the tariffs remains in force. The claim for damages submitted by the Company against the CA, has been suspended until the final verdict has been reached in the matter. AS Tallinna Vesi submitted the claim on 2nd of May 2014, to avoid the expiry of monetary claim.
