About the Lawsuit

Emergent and certain of its executives are charged with failing to disclose material information during the Class Period, violating federal securities laws. 

The alleged false statements include, but are not limited to, that the U.S. government’s demand for Emergent’s anthrax vaccine (BioThrax) was strong and growing and Emergent believed the government would renew its 5-year exclusive anthrax vaccine procurement contract.

On June 22, 2016, it was revealed that the U.S. Department of Health and Human would be purchasing less BioThrax, purchase doses of a next-gen anthrax vaccine when one was approved, and seek bids from other companies for the remainder of its anthrax vaccine procurement.

On this news, the price of Emergent’s shares plummeted.
