Supreme Court terminated proceedings related to AS Tallinna Vesi’s damages claim against the Estonian Competition Authority


On 5th November 2019 Supreme Court terminated proceedings in administrative case 3-14-363 upon AS Tallinna Vesi’s withdrawal application and annulled the 19 November 2018 judgment of the Tallinn Administrative Court and the 19 June 2019 judgment of the Tallinn Circuit Court. Termination of the proceedings means that the dispute has ended without awarding any compensation for damages from the Competition Authority in favour of AS Tallinna Vesi.

The administrative case concerned AS Tallinna Vesi’s complaint against the Competition Authority regarding the compensation for loss of tariff income as well as the complaints challenging the refusal to review AS Tallinna Vesi’s applications for the approval of water tariffs for 2013-2017. Tallinn Administrative Court had dismissed the Company’s claims with its decision dated 19 November 2018. AS Tallinna Vesi appealed the Administrative Court’s decision on 19 December 2018. Tallinn Circuit Court dismissed the appeal on 19 June 2019. The Competition Authority approved AS Tallinna Vesi’s new water tariffs on 18 October 2019. Considering all the circumstances AS Tallinna Vesi decided to withdraw its complaints submitted in administrative case 3-14-363.
