Max Sound to File an Appeal in US Infringement Case Against Google


SANTA MONICA, CA--(Marketwired - November 25, 2015) - Max Sound Corporation, (OTCQB: MAXD) inventors of MAX-D HD audio solutions, and worldwide license holder of VSL Optimized Data Transmission technology announced today that the company and its legal team plan on filling an appeal of Judge Edward J. Davila's ruling.

On October 1, 2014 Max Sound filed a Patent Infringement case against Google, Inc. and Youtube in the Northern District of California to enforce its worldwide rights to Optimized Data Transmission technology. Then on May 13, 2015 Google filed a motion that was denied by the court in favor of Max Sound, stating that Max Sound had sufficiently alleged the existence and validity of the '339 Patent. On August 28, 2015 Google filed a motion to dismiss the complaint alleging that the issued claims were invalid. Then on November 24, 2015 Google's request was granted based only on the standing issue. Max Sound will initiate the appeal process imminently.

The Company's other actions against Google are continuing as scheduled.
