Schwandorf, October 21, 2009. As of October 20, 2009, the Managing
Directors of Schmack Biogas' subsidiaries Stelzenberger Biogas GmbH
(Kirchweidach), Carbotech Engineering GmbH (Essen) and Hese Biogas GmbH
(Gelsenkirchen) filed an application for opening of insolvency proceedings
due to imminent failure of pay. Intensive negotiations with banks and
investors concerning the financing of the Schmack Biogas Group turned out
unsuccessfully. Thus, the Management Board of Schmack Biogas (Schwandorf)
also filed an application for opening of insolvency proceedings due to
imminent failure of pay. The Management Board of Schmack Biogas as well as
the Management Directors of the subsidiaries intend to continue the
operative business under self-administration and the restructuring in a
planned insolvency process in cooperation with a Chief Restructuring
Officer (CRO).
