Class Action Filed on Behalf of New Hampshire Residents

These residents were exposed to PFOA and PFOS in their water supply


NEW YORK, NY--(Marketwired - December 09, 2016) - The Law Firms of Napoli Shkolnik PLLC and Nixon, Vogelman, Barry, Slawsky & Simoneau P.A. have filed a class action complaint in the United States District Court for the District of New Hampshire against Saint-Gobain Performance Plastics, on behalf of twenty-two Southern New Hampshire residents who were potentially exposed to perfluorooctanoic acid (PFOA) and perfluorooctane sulfonate (PFOS) in the water supply of Merrimack and Litchfield New Hampshire.

The class action complaint alleges that plaintiffs and other similarly situated residents of the Merrimack and Litchfield area have been exposed to high levels of perfluorinated compounds (PFCs), and are now at an increased risk of several health effects, including effects on the liver and the immune system, high cholesterol, changes in thyroid hormone, as well as kidney and other cancers. The complaint also states that property values in the area have dropped as a result of the contamination.

Saint-Gobain Performance Plastics, as operator of a plastics plant on Daniel Webster Highway in Merrimack, used PFCs to manufacture products resistant to heat, stain, and water, and carelessly discharged PFCS in the environment, contaminating the groundwater and water supply in Merrimack and Litchfield. Saint-Gobain's facilities have been linked to the contamination of surface and groundwater with PFCs throughout the country, including in Hoosick Falls, New York and Bennington, Vermont.

On February 26, 2016, Saint-Gobain Performance Plastics reported to the New Hampshire Department of Environmental Services that PFOA was detected at 30 parts per trillion in water supplied by the Merrimack Village District Water System. To date, over 500 private wells have been tested near the Saint-Gobain Performance Plastics site in Merrimack, New Hampshire. As a result of the PFOA contamination, nearly 350 Southern New Hampshire properties are receiving bottled water from the State.

Parents such as Jennifer and Johnathan Kiley from Merrimack are concerned for the health and future of their four young children. Studies show an association between increased PFOA blood levels and increased risks for several health effects in children (for example, effects on birth weight, cognitive and behavioral development, immune function, and cholesterol levels).
