While the case continues to move forward, Mr. Huffman explains that the
proceedings have been pushed back slightly as a result of court delays.
"The lawsuit is on track, but the track has been slightly adjusted. There
were some docket management problems that were an issue in the judge's
chambers, having nothing to do with this case itself, and the result of
that is a push back in the schedule of approximately two months. The trial
date as it is set now, according to an order dated June 29th, 2007, is
April 8th, 2008 and the intermediate dates between now and then for the
most part have been adjusted by a similar time frame."
In what appears to be a David and Goliath scenario, USA Video continues to
hold its course. "It is the small company against the 'big guys' here and
the key is patience and perseverance such as we showed when we as a company
performed the evaluation necessary to be able to bring this suit to life in
the first instance, and we have to have the fortitude to stick it out
through to the end. We are looking forward to having our day in court,"
states Huffman.
