The ruling of the Environmental Court, which was made public on Friday December 21, 2007 at 11:00 a.m., granting permission and stipulating the conditions for the mining and processing plant project of Lappland Goldminers AB at Fäboliden in the municipality of Lycksele in Västerbotten, has been appealed to the Miljööverdomstolen (Supreme Environmental Court). Three land owners and Naturvårdsverket (Swedish Environmental Protection Agency) have appealed the decision of the court. The fact that the ruling was appealed is not surprising to us, as some land owners have been opposing our establishment in Fäboliden all along. What is very surprising, however, is that the ruling has been appealed by Naturvårdsverket. Naturvårdsverket has been one of the parties given the opportunity to review our submissions during the entire environmental impact study process. Throughout this they have concurred with the views of the County Administrative Board concerning changes and handlings needed to approve our planed activity. During the review process we have adapted our application to comply with, among others, the views of Naturvårdverket, and after this they abstained from further demands for changes or handlings. They furthermore elected not to take part in the negotiations in the Environmental Court. To now then appeal, without specifying their reasons and on top of this also requesting an extension for submitting their views, we consider abuse of authority and lack of respect for both commercial interests who have invested millions in the application for environmental permit for the activity and the process that the legislator assumed when introducing the Environmental Code. We will request a ruling allowing us to go ahead in accordance to the Environmental Court ruling and that they do not grant the extension for Naturvårdsverket in submitting their answer, says Karl-Åke Johansson, CEO.
