U.S. Patent and Trademark Office Confirms Patentability of Lumension's Proprietary Patching Technology; Court Lifts Stay on Lumension/Shavlik Litigation


SCOTTSDALE, AZ--(Marketwire - August 11, 2009) - Lumension®, the global leader in operational endpoint management and security, today announced that the U.S. Patent and Trademark Office has issued an Action Closing Prosecution confirming all existing claims of Lumension's U.S. patent to its proprietary patching technology. In addition, the U.S. District Court for the District of Arizona has granted Lumension's request and lifted its stay on related Lumension/Shavlik litigation. Outlined below are specifics regarding the events:

--  On May 12, 2009, the U.S. Patent and Trademark Office ("PTO") issued
    an Ex Parte Reexamination Certificate to Lumension Security, Inc., stating
    that more than 50 claims of Lumension's U.S. patent relating to its
    proprietary patching technology (U.S. Patent No. 6,990,660, or the "'660
    Patent") are considered patentable, as amended.
--  On May 19, Shavlik Technologies, LLC ("Shavlik") filed an Inter Partes
    reexamination request with the PTO, asking the PTO to reexamine the
    Lumension patent.  This was the second reexamination request filed by
    Shavlik, and was filed after the first reexamination had successfully
    concluded for Lumension on May 12, 2009, as stated above.
--  On July 24, 2009, the PTO  granted the Inter Partes reexamination
    request, but simultaneously issued an Action Closing Prosecution where all
    existing claims of the '660 patent (i.e., reexamined claims 1-5, 8-23, 25-
    48 and 51-61) were confirmed as being patentable.
--  On July 27, 2009, the U.S. District Court for the District of Arizona
    lifted its stay on the related Lumension/Shavlik litigation and gave the
    parties a period of time within which to meet and confer prior to setting a
    scheduling conference.
