SmartMetric, Inc. Files Motion in Visa MasterCard Case

Calls for a Jury Trial Against MasterCard and Visa in Its Patent Infringement Case


BAY HARBOR, FL--(Marketwire - June 23, 2010) -  SmartMetric, Inc. (OTCBB: SMME) announced today that the Company filed an opposition to defendant MasterCard Incorporated ("MasterCard") and Visa, Inc.'s ("Visa") June 14, 2010 "Motion to Dismiss for Failure to State a Claim."

As set forth in the Company's opposition to the defendant's motion to dismiss, "The First Amended Complaint seeks monetary and injunctive relief, and properly alleges jurisdiction and venue. The Company's opposition concludes by reiterating that the defendants "have adequate information to answer. The Court should deny their motion and Order defendants to answer." 

A hearing on the defendant's motion is presently scheduled to be heard on July 12, 2010 at 2:00 pm in the United States District Court for the Central District of California.

Commenting on the Company's response to the defendant's motion to dismiss, SmartMetric's CEO Colin Hendrick said, "While the Company expected delaying tactics by the defendants, they have shown an unwillingness to deal with the substantive merits of our case. But they can only delay for so long before they will be in the courtroom facing our serious complaint against them."
