Scott+Scott LLP Announces Court Denial of Weather Shield's Motion to Dismiss

NEW YORK, July 18, 2011 (GLOBE NEWSWIRE) -- On May 11, 2011, the Honorable Paul C. Huck of the United States District Court for the Southern District of Florida issued an order denying Defendant Weather Shield Manufacturing, Inc.'s motion to dismiss in Gavron v. Weather Shield Mfg., Inc., Case No. 10-22088 (S.D. Fla.). This consumer protection lawsuit is a putative class action that is being litigated by Scott+Scott LLP and the Egleston Law Firm on behalf of their client and a putative class of consumers who purchased or otherwise own certain windows and/or doors from Weather Shield Mfg. Inc. identified as the Weather Shield Legacy Series.

Plaintiff's complaint alleges that Weather Shield's Legacy Series of windows and doors are defective because, among other defects, they are not properly sealed, are improperly finished, contain defective weather stripping and are misaligned. In its order denying Weather Shield's motion to dismiss, the Court found that the Plaintiff had adequately plead claims for violations of the Florida Deceptive and Unfair Trade Practices Act (FDUTPA) and breach of express warranty. If you have any questions or if you purchased or otherwise own Weather Shield Legacy Series windows and/or doors and you have experienced problems with these products, such as leaking, rotting, delamination or water or air infiltration, you may contact Michael Burnett at Scott+Scott LLP at 1-800-404-7770, www.mburnett@scott-scott.com or Gregory Egleston of the Egleston Law Firm at 212-683-3400.
