Stk'emlupsemc: Judge Cannot Hear Injunction Application


KAMLOOPS, BRITISH COLUMBIA--(Marketwire - Sept. 27, 2011) - Upon the application of the Stk'emlupsemc te Secwepemc Nation, Judge Robert Sewell recused himself from hearing the SSN's injunction application on Monday, September 26, 2011. At the start of the hearing, Judge Sewell advised that he had in the past acted on behalf of Weyerhaeuser. In his oral reasons recusing himself from hearing the matter Judge Sewell made it clear that there was some basis for an apprehension of bias arising out of his having acted for one of the parties named in the court action, Weyerhaeuser, in the past. A new judge will need to be assigned to hear the highly contentious forestry case and in the meantime the SSN work towards getting West Fraser and Government to come to the table.
