Sarraf Gentile LLP Investigates Reported Charity Scam

NEW YORK, NY--(Marketwire - Sep 12, 2012) - Sarraf Gentile LLP is investigating an alleged "charity scam" in which telemarketers deceive the donors they solicit about who receives most of the money they raise. According to the allegations, most of the money goes to the telemarketer, not the charity.

According to Bloomberg Markets Magazine and the Huffington Post, employees at the telemarketing company InfoCision Management Corp. were instructed to say that at least 70 percent of the money that they raise for the American Cancer Society and the American Diabetes Association will go toward charity. But these charities, according to Bloomberg, agreed to give InfoCision more than half of the money InfoCision raised. In fact, InfoCision kept all of the donation money that it raised on behalf of the American Cancer Society in 2010, according to Bloomberg.

The well known affected charities cited by Bloomberg and the Huffington Post include: the American Cancer Society, the American Diabetes Association, the American Lung Association, the American Institute for Cancer Research, and the March of Dimes.

In April 2012, the Ohio Attorney General found reason to believe that InfoCision made misleading statements and failed to make required disclosures during the course of charitable solicitations. According to the Ohio Attorney General's office, InfoCision agreed to "Stop all misleading behavior and making misrepresentations as to the percentage of donations that a charity will receive." InfoCision has also settled civil complaints charging it with violating fundraising laws in six other states since 2009, according to Bloomberg. Sarraf Gentile LLP has not filed any lawsuits regarding this matter.
