According to the court documents associated with the lawsuit, the plaintiff was driving her vehicle within the borders of Clark County when she encountered a situation where she had the right-of-way. The documents went on to state that at this location, the defendant allegedly failed to yield the right-of-way and that this failure directly caused a collision between the two vehicles. The plaintiff suffered a serious injury to her leg that required hospitalization, surgery, ongoing medical oversight and medication.

As a result of this accident, the plaintiff filed the lawsuit and in the court documents alleged that: (a) the defendant owed the plaintiff a legal duty of care; (b) the defendant breached that duty of care by failing to act as a reasonable person would have in that situation; (c) this breach of the defendant's duty of care caused the injuries suffered by the plaintiff; and (d) the plaintiff suffered actual damages as a result of the collision.
