no 90/13 Changes to the Clearing Rules in relation to EMIR will be implemented on December 2, 2013


NASDAQ OMX Clearing AB has agreed with the Swedish Financial Supervisory Authority that the rule amendments in relation to EMIR published on October 23, 2013 in Notice No 82/13 will come into effect on December 2, 2013.

Following consultation with clearing participants, certain amendments have been made to the Clearing Rules published on 23 October 2013. These amendments are presented below.

Please note that the amendments referenced herein are subject to change following further discussions with relevant regulatory authorities.

Clearing participants should note that NASDAQ OMX Clearing AB intends to make further amendments to its Clearing Rules on or before January 1, 2014, including changes to reflect the provisions of CRD IV.

CHANGES IN THE GENERAL TERMS
Section 9.5. This section has been amended in line with comments received from clearing participants to make it clear that any right of access would be subject to relevant statutory and regulatory limitations, such as bank secrecy obligations.

CHANGES IN CLEARING APPENDIX 12 – SUPPLEMENTAL DEFAULT RULES FOR CLEARING TRANSACTIONS RECORDED ON CLIENT CLEARING ACCOUNTS

The definition of “Associated Client Transaction” has been slightly amended in line with comments received from clearing participants.

The Client indemnity in Section 10.2(e) has been narrowed in scope, and a restriction on its use has been inserted, in line with comments received from clearing participants.
